Welcome to LAVARAMA LLC. The terms “we,” “us,” and “our” refer to LAVARAMA LLC. LAVARAMA LLC operates this store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”).

Our Services include both:

Retail sales, and
Lavarama Pickup, our wholesale-style, cash-and-carry service designed for customers purchasing in volume, including resellers.

LAVARAMA LLC is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use our Services. Please read them carefully, as they include important information regarding legal rights, disclaimers, and limitations of liability.

By visiting, accessing, browsing, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you have given consent for any minor dependents using devices you own, purchase, or manage.

To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing information, payment information, shipping information, and other account details. We do not warrant that the appearance, packaging, or quality of any product or service will be exactly as depicted on the website or will meet every expectation.

All product descriptions, quantities, pricing, availability, and packaging are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and to limit quantities on a case-by-case basis.

Retail Store

Some products and services offered through our website or store are intended for personal, household, or general consumer use.

Lavarama Pickup

Lavarama Pickup operates as a wholesale-style, cash-and-carry service designed for customers purchasing in volume, including resellers and business customers.

Products sold through Lavarama Pickup are offered at discounted pricing based on:

Bulk purchasing
Self-service pickup
Final sale conditions
Limited service model
Customer inspection and acceptance at pickup

For Lavarama Pickup orders, customers may purchase for resale, provided they comply with all applicable laws and requirements.

SECTION 4 – ORDERS

When you place an order, you are making an offer to purchase. LAVARAMA LLC reserves the right to accept, reject, cancel, or limit any order at its sole discretion and for any reason.

Your order is not accepted until we confirm acceptance and receive/process payment as required.

Please review your order carefully before submitting. Once an order has been accepted, we may be unable to accommodate cancellation requests.

If we reject, modify, or cancel an order, we will attempt to notify you using the contact information provided at the time of purchase.

Retail Orders

Retail purchases may be subject to any posted Refund Policy.

Lavarama Pickup Orders

Lavarama Pickup orders are subject to the specific terms in these Terms of Service, including:

Minimum order requirements
Case quantity requirements
Pickup timing requirements
Inspection and acceptance requirements
Final sale policy

For Lavarama Pickup, all sales are final unless an issue is identified at pickup before acceptance and signature.

SECTION 5 – PRICES, MINIMUM ORDER, AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed.

Unless otherwise expressly stated, posted prices may not include shipping, handling, customs, import charges, or taxes.

Lavarama Pickup Minimum Order

A minimum purchase of $300 USD before tax is required to access Lavarama Pickup pricing.

Taxes

Sales tax will apply unless a valid reseller permit or resale certificate is provided and accepted at checkout or before release of the order, as applicable.

Billing

You agree to provide current, complete, and accurate purchase, billing, payment, and account information. You authorize us to charge your selected payment method for the total amount due, including applicable taxes and fees.

You represent and warrant that:

The payment information you provide is accurate and complete;
You are authorized to use the payment method provided;
Charges incurred will be honored by your payment provider; and
You will pay all amounts due.

SECTION 6 – PRODUCT CONDITIONS AND CASE REQUIREMENTS

For Lavarama Pickup:

Products less than or equal to 1 liter or 1 kilogram must generally be purchased in full case quantities.
Products greater than 1 liter or 1 kilogram may be sold individually, although case purchases are encouraged.
Availability is subject to inventory on hand at the time of fulfillment.
We reserve the right to adjust, substitute, or limit quantities if inventory changes before pickup.

SECTION 7 – ORDER FULFILLMENT, PICKUP, SHIPPING, AND DELIVERY

Pickup Orders

Orders are generally prepared Monday through Friday. Orders placed on weekends may be processed on the next business day.

Customers are responsible for picking up orders within the designated or agreed timeframe.

We are not responsible for:

Delays caused by late pickup by the customer
Storage beyond a reasonable period
Loss, damage, or deterioration resulting from delayed pickup after the order is ready

Shipping and Delivery

If shipping is offered, all delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing, weather, or events outside our control.

Once products are transferred to the carrier, title and risk of loss pass to you, unless otherwise required by law.

SECTION 8 – INSPECTION, ACCEPTANCE, AND FINAL SALE

For Lavarama Pickup, customers are required to inspect all merchandise at the time of pickup and before leaving with the order.

Before accepting the order, the customer must verify:

Product quantity
Correct items
Product condition
Visible damage or shortages

Customers may be required to sign an Order Acceptance Confirmation stating that:

The order is complete
The merchandise is in acceptable condition
The customer has inspected the order
The customer accepts the final sale terms

Final Sale Policy – Lavarama Pickup

All Lavarama Pickup sales are final.

Once the order has been:

Inspected
Accepted
Signed for

No returns, exchanges, refunds, or credits will be accepted.

Any issues, including:

Damaged merchandise
Missing items
Incorrect products

must be reported at the time of pickup and before signing. We will make reasonable efforts to resolve valid issues on-site at pickup. No claims will be accepted after acceptance and signature.

SECTION 9 – PAYMENT TERMS

Payment is required prior to or at the time of pickup.

Accepted payment methods may include:

Cash
Credit/debit card
Other approved payment methods

Orders will not be released until payment has been completed and confirmed.

SECTION 10 – RESELLER RESPONSIBILITY

Customers purchasing products for resale are solely responsible for:

Compliance with all local, state, and federal laws and regulations
Proper labeling, storage, handling, transport, and resale of products
Any permits, licenses, or resale documentation required by law

LAVARAMA LLC is not responsible for how products are handled, stored, or resold after pickup or delivery.

SECTION 11 – RIGHT TO REFUSE SERVICE

We reserve the right, at our sole discretion, to:

Refuse service to any customer
Limit quantities
Cancel orders
Suspend or terminate accounts
Refuse future transactions
Modify or discontinue products or services

SECTION 12 – INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof, are owned by LAVARAMA LLC, its affiliates, licensors, or partners and are protected by applicable intellectual property laws.

Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from our Services without prior written consent.

LAVARAMA LLC’s names, logos, product names, service names, designs, and slogans are trademarks of LAVARAMA LLC or its affiliates or licensors. Shopify’s name and related marks are trademarks of Shopify.

SECTION 13 – OPTIONAL TOOLS

We may provide access to third-party tools that we do not monitor, control, or endorse. Such tools are provided “as is” and “as available,” without warranties of any kind.

Your use of optional third-party tools is entirely at your own risk and subject to the third party’s terms.

The Services may contain links to third-party websites or services. We are not responsible for examining or evaluating their content, accuracy, or policies.

If you access third-party sites, you do so at your own risk. Complaints or questions regarding third-party products or services should be directed to the third party.

SECTION 15 – RELATIONSHIP WITH SHOPIFY

LAVARAMA LLC is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with LAVARAMA LLC.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and LAVARAMA LLC, including any injury, damage, or loss resulting from purchased products or services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with LAVARAMA LLC.

SECTION 16 – PRIVACY POLICY

To violate any law or regulation
To infringe on our rights or the rights of others
To harass, abuse, defame, intimidate, or harm others

We may terminate this agreement or your access to the Services at any time, without notice, in our sole discretion.

You remain liable for all amounts due up to the date of termination.

Any provisions that by their nature should survive termination will remain in effect, including but not limited to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and privacy obligations.

SECTION 22 – DISCLAIMER OF WARRANTIES

The Services and all products offered through them are provided on an “as is” and “as available” basis, except as expressly stated otherwise by LAVARAMA LLC.

We do not guarantee that:

The Services will be uninterrupted, secure, or error-free
Product listings will always be complete or current
Products will meet all expectations
Pickup availability or preparation timing will be uninterrupted

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

SECTION 23 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, LAVARAMA LLC, its affiliates, officers, directors, employees, agents, contractors, service providers, licensors, and Shopify and its affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to:

Lost profits
Lost revenue
Loss of business
Resale losses
Storage losses
Loss of data
Replacement costs

This limitation applies to any claim arising out of or related to your use of the Services or the purchase, use, pickup, storage, transport, or resale of products.

For Lavarama Pickup specifically, we are not liable for:

Customer resale issues
Delays in pickup by the customer
Improper use, handling, or storage after pickup
Indirect or consequential losses after acceptance of the order

All products are deemed accepted as is at the time of customer acceptance and signature.

SECTION 24 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LAVARAMA LLC, Shopify, and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, losses, liabilities, damages, or expenses, including reasonable attorneys’ fees, arising out of or related to:

Your breach of these Terms;
Your violation of any law or regulation;
Your infringement of any third-party rights; or
Your use of the Services or resale/use of purchased products.

SECTION 25 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

SECTION 26 – WAIVER; ENTIRE AGREEMENT

These Terms, together with any policies referenced herein, constitute the entire agreement between you and LAVARAMA LLC regarding the Services and supersede all prior communications or agreements.

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent.

We may assign, transfer, or delegate these Terms and our rights or obligations without notice to you.

SECTION 28 – GOVERNING LAW

These Terms of Service and any separate agreements under which we provide Services shall be governed by and construed in accordance with the laws and courts of the jurisdiction where LAVARAMA LLC is headquartered, unless otherwise required by applicable law.

You consent to venue and personal jurisdiction in such courts.

The headings used in these Terms are for convenience only and do not affect interpretation.

SECTION 30 – CHANGES TO TERMS OF SERVICE

We reserve the right to update, modify, or replace any part of these Terms at any time by posting changes to our website.

It is your responsibility to review the Terms periodically. Your continued use of the Services after any changes are posted constitutes acceptance of those changes.

SECTION 31 – AGREEMENT TO TERMS

By placing an order with LAVARAMA LLC, including through Lavarama Pickup, you confirm that you:

Have read and understood these Terms of Service
Agree to all applicable policies
Understand that Lavarama Pickup orders are subject to inspection at pickup
Understand that Lavarama Pickup sales are final once inspected, accepted, and signed for
Understand that no returns, exchanges, or refunds will be accepted after acceptance of a Lavarama Pickup order
